Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the BabyArt AI mobile app (the "App"), you agree to these Terms of Service (the "Terms"). If you do not agree, do not use the App and remove it from your device.

The App is provided by Sercan Cidem (individual) ("we", "us").

2. Description of the Service

BabyArt AI is a mobile application that lets users select baby photos from their device and combines them with bundled templates to create artwork, using Apple's Vision Framework for on-device segmentation. All processing is performed locally on the device; no data is transmitted to remote servers.

3. Age Requirement

You must be at least 18 years old, or have the consent of a legal guardian, to use the App. The App is designed for parents to create artwork from photos of their own babies.

4. User Responsibilities

When using the App, you agree to:

• Use only photos that you own or have explicit permission to use
• Not upload photos of third parties (especially children) without consent from a parent or legal guardian
• Not use the App to produce illegal, harassing, obscene, or otherwise harmful content
• Not attempt to bypass security measures, reverse-engineer, or otherwise misuse the App

5. Subscription Terms

5.1 Subscription Tiers and Pricing

The App may require a subscription to unlock certain features. Available subscriptions:

• Weekly Subscription — includes a 3-day free trial
• Yearly Subscription — does not include a free trial

Current prices are displayed in the App at the time of purchase and may vary by region. We reserve the right to update prices at any time.

5.2 Auto-Renewal

• All subscriptions renew automatically — your Apple ID account will be charged for the next period unless you cancel at least 24 hours before the end of the current period.
• Renewal charges are made within 24 hours of the end of the current period.
• To manage subscriptions and disable auto-renewal, go to your Apple ID account: Settings > Apple ID > Subscriptions.

5.3 Free Trial

• The 3-day free trial applies only to the Weekly Subscription and is available once per account.
• If you do not cancel before the trial ends, you will be charged the weekly fee.
• You must cancel at least 24 hours before the trial ends.

5.4 Cancellation and Refunds

• You may cancel your subscription at any time through Apple ID settings; you retain access to premium features until the end of the current period.
• Refund requests are governed by Apple's refund policy: support.apple.com/HT204084
• We cannot directly process refunds for subscriptions sold through Apple.

5.5 Price Changes

If subscription prices change, you will be notified through Apple, and changes will apply from your next renewal period.

6. Intellectual Property

• App content (logo, templates, backgrounds, code, design): owned by us. We grant you a limited, personal, non-transferable license to use it.
• Your photos: owned by you. Outputs you create remain your property.
• License on templates: outputs may be used for personal and non-commercial purposes. You may not isolate template content for resale or integration into other services.

7. Disclaimer of Warranties

The App is provided "as is". To the maximum extent permitted by law, we make no express or implied warranties, including merchantability, fitness for a particular purpose, or uninterrupted operation.

8. Limitation of Liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability is limited to the amount you paid for the App in the 12 months preceding the relevant event.

9. Apple App Store EULA

By downloading the App from the App Store, you also agree to Apple's Licensed Application End User License Agreement ("Apple EULA"). In case of any conflict between these Terms and the Apple EULA, the Apple EULA takes precedence. Apple EULA: apple.com/legal/internet-services/itunes/dev/stdeula

10. Termination

We reserve the right to terminate your access to the App if you breach these Terms. You may stop using the App at any time by removing it from your device.

11. Changes to These Terms

We may update these Terms occasionally. Material changes will be announced in the App. Continued use of the App after changes constitutes acceptance.
